U.S. court reinstates Biden federal employee COVID vaccine mandate -Breaking

WASHINGTON, (Reuters) – A U.S. appeals panel reinstated Thursday’s Executive Order by President Joe Biden mandating federal civil employees to be vaccinated for COVID-19.

A 2-1 vote by the 5th Circuit Court of Appeals overturned an injunction that was issued in January in Texas by a U.S. federal district judge, which had prevented the enforcement of the federal vaccine mandate for employees. Biden stated in September that he required approximately 3.5 million federal workers to be vaccinated before Nov. 22. This was without regard for religious or medical accommodations or they could face firing.

Both the Justice Department and White House did not respond immediately.

Biden’s administration claimed that the federal trial court was not authorized to resolve the dispute. According to the administration, employees had to file a grievance under the Civil Service Reform Act (CSRA).

According to the panel majority, the plaintiffs sought “to circumvent the CSRA’s exclusive review system” and the court rejected the “invitation.”

Federal employee disputes usually occur before the Merit Systems Protection Board and then the Washington D.C.-based Federal Circuit Appeals court. The Justice Department stated in its court filings.

The government lawyers stated in court filings that the injunction “severely harms the public interests by impeding efforts for reductions from COVID-19 federal workplaces.”

The White House stated that more than 93% Federal employees had received at least one shot and 98% were vaccinated, or seeking religious or medical exemptions.

In mid-January, the U.S. Supreme Court blocked Biden’s COVID-19 vaccination-or-testing mandate for large businesses, a policy conservative justices deemed an improper imposition on the lives and health of many Americans. Separate federal vaccination requirements were allowed by the court for healthcare facilities.

Federal Judge in December blocked a third important vaccine requirement that was directed at federal employees like manufacturers and airlines.
