Jan. 6 panel has enough evidence to refer Trump for criminal charges, Cheney says

A House committee investigating the attack on U.S. Capitol Jan. 6, 2021 has sufficient evidence to charge President Donald Trump with criminal offenses. Rep. Liz Cheney, R-Wyo.Sunday,

It’s clear that Trump did what he was doing. It was what a lot of his friends were doing. They knew that it was illegal. It was done anyway.” Cheney, the vice chairman and one of the Republicans on the commission, stated on CNN’s “State of the Union”, when Jake Tapper asked him if the evidence they have to criminally refer the ex president. Cheney stated that no decision has been made by the panel to move forward with referral.

She made her comments after the New York Times reported that the committee has concluded that they have enough evidence to make a criminal referral but its leaders were split over whether to do so.

Cheney claimed that what they have witnessed was “a large and organized effort to attempt to change an election through multiple means.” This committee “has received a lot of documents and testimony that, I believe very strongly, demonstrate the scope of the planning as well as the organization of the goal.”

Cheney said, “The object was absolutely stop the kind electoral votes, and try to interfere in that official proceeding.” It is clear they knew exactly what they were doing was wrong.

She referenced a ruling in civil action involving the Committee last month. In it, a federal judge ruled that Trump “attempted to obstruction the joint session Congress” on day of attack. That would be a crime.

“The illegality of the plan was obvious,” U.S. District Judge David Carter wrote of Trump and lawyer John Eastman’s plan to have then-Vice President Mike Pence determine the results of the 2020 election. “Every American — and certainly the president of the United States — knows that in a democracy, leaders are elected, not installed. Trump tried to subvert the fundamental principle of democracy by devising a plan so bold.

Jan. 6 Panel similar allegations in a court filing in the case last month, saying it had “good-faith basis for concluding that the President and members of his Campaign engaged in a criminal conspiracy to defraud the United States.”

Trump has never been accused of a crime.
