LOS ANGELES, (Reuters) – Monday’s release by a New Mexico County Sheriff of case documents from the investigation into last year’s shooting at the movie “Rust,” reveals that a formal determination on criminal charges will depend upon the analysis of DNA, ballistics and phone calls of Alec Baldwin and his producer.

Rust Movie Productions was fined $137,000 by New Mexico for “willful” safety violations that led to Halyna Hutchins’ death as a cinematographer.

Hutchins (42 years old) was shot in the chest by Baldwin’s revolver. The bullet lodged in Souza’s shoulder. Souza was able to survive the gunshot wound.

Baldwin denies responsibility and says live rounds were not allowed on the Bonanza Creek Ranch set for the Western movie.

Santa Fe County Sheriff Adan Menzo, who previously stated that criminal charges might be a possibility, made Monday a written statement stating that all files related to the investigation would soon become public.

According to him, those files include body-worn cameras and dashboard cameras as well as crime scene photos and reports.

Mendoza stated in the statement that “various components of this investigation remain unsolved”, including FBI firearm, ballistic forensics, DNA and latent fingerprint analyses, coroner’s (coroner) findings, and analysis of Mr. Alec Baldwin’s phone data taken by Suffolk County Sheriff’s investigators.”

Baldwin was a producer of the film and has been named by several people in lawsuits brought against Hutchins, one being filed by Matthew.

According to court documents, the actor at 64 years old argued that an indemnification clause contained in his contract protects him from any personal liability arising from claims relating to film production.
