LOS ANGELES (Reuters), A man, 23, was arrested for attacking Dave Chappelle while he performed during a concert. He was not charged with any other serious offenses by the district attorney.

Isaiah Lee was brought down by Chappelle after he pushed him to the floor.

In a recorded message, Mike Feuer, City Attorney said that “this alleged attack must have consequences.”

Feuer issued the misdemeanor accusations just hours after George Gascon (the city’s top lawyer) declined to pursue Lee. Gascon’s spokesperson said that the evidence had not been reviewed and did not support felony conduct.

California law allows a misdemeanor to be sentenced up to one year in jail. Feuer’s Los Angeles office handles misdemeanor cases while the district attorney deals with felony cases.

The police say that Chappelle was at the Hollywood Bowl performing on Tuesday, when Lee attacked him. Lee tried to run away but was forced back onto the ground near the back.

Chappelle, after taking a break, returned to the main stage and carried on his show. He also made a few jokes about it. He didn’t appear to have been hurt.

Representatives of the performer stated Wednesday that they were fully cooperating in the investigation by police.

His spokesperson Carla Sims said that “as unfortunate as it was, Chappelle continued with the show,” and that she credited Chris Rock and Jamie Foxx for helping “calm” the crowd.

This attack was compared to an incident at the Academy Awards in March, when Will Smith punched comic Chris Rock onto stage. It is believed that it was over a joke about Jada Pinkett Smith.

Rock joined Chappelle shortly after the attack. He took the microphone, and quipped “Was it Will Smith?”
