Michigan judge blocks enforcement of state’s pre-Roe v. Wade abortion ban -Breaking

(Reuters) – Tuesday’s Michigan court ruling allowed a temporary injunction against the imposition of a ban on state abortion. This could have been effective if the U.S. Supreme Court reverses Roe v. Wade, which legalized abortion nationally.
An Michigan Court of Claims Judge in Lansing supported Planned Parenthood, women’s healthcare provider in the lawsuit it filed against the state to prevent the possible enforcement of its ban. It was first enacted in 1931.
It appears that the U.S. Supreme Court is ready to revise the constitution’s right for abortion. Politico published on May 2 a draft opinion of Justice Samuel Alito. This showed that the conservative court wanted to repeal 1973 Roe V. Wade, the ruling which established abortion rights nationwide. Expect the final court decision to be made in June.
Michigan and nine other states have bans against abortion on their books. They were in effect before Roe V. Wade, which can potentially be overturned.
Court of Claims judge Elizabeth Gleicher said in her opinion, “Forced Pregnancy and the associated compulsion of suffering the mental and physical risks it entails, contravene our right to make medical autonomous decisions.”
Michigan’s law of 1931 criminalizes abortions, except when it is necessary to preserve the life of a pregnant woman.
Planned Parenthood (Democrat) and Michigan Governor Gretchen Whitmer filed suits last month to block the law’s effective.
“Today’s ruling means all Michiganders will continue to be able to access the health care they deserve and to be able to decide for themselves their own futures,” Sarah Wallett, chief medical officer of Planned Parenthood of Michigan, said in a statement.
Whitmer expressed gratitude to the judge for his decision Tuesday and stated in a statement, “Will help ensure Michigan continues to be a place that women can have freedom and control over themselves.”
Whitmer stated that she was still pressing the state Supreme Court, to confirm the right of abortion in the state constitution. This is to ensure access to abortions. Whitmer’s campaign began last month.
Right to Life of Michigan (an anti-abortion organization) called Whitmer’s request of Michigan’s highest court “autocratic” during an April Twitter statement.
The group representatives did not respond immediately to our request for comment regarding Tuesday’s decision by the judge.
