(Reuters) – Amber Heard and Johnny Depp’s lawyers plan to bring Johnny Depp back on Monday to witness stand at the beginning of the last week in their defamation hearing.
Depp, who is 58 years old, sued Heard in Virginia, alleging that she defamed his character when she stated she had been abused by her husband. Heard (36), has countersued Depp for $100 million, saying that Depp defamed her and called her a lie.
Heard claimed that he did not hit him and that his “Pirates of the Caribbean’ star was the one who abused them. Depp claimed that Heard had thrown a vodka bottle at his hand in 2015 and ripped the tip of his right thumb.
Heard stated that the finger injuries were not her fault and she said she was only hitting him in self-defense or for her sister.
The trial’s closing arguments are set for Friday.
Monday’s jurors were presented graphic photographs of Depp’s broken finger. They also heard testimony from Dr. Richard Moore who was called by Heard as an expert witness.
Moore reviewed Depp’s medical records and said that he didn’t believe Depp sustained the injury in the manner Depp described.
He stated that “the wound does not really look like a sharp, glass laceration.”
Moore stated that he thought it was an “accident,” but Depp’s lawyers asked him to admit that he cannot say with certainty what happened.
Heard testified she believed Depp had injured himself by smashing a phone wall-mounted into “smithereens”.
Heard and Depp first met during filming of “The Rum Diary”. Heard and Depp were married in February 2015, but their divorce took place two years later.
Heard’s December 2018 Washington Post opinion piece is the focus of this legal case. Depp wasn’t mentioned by name in the article but Heard’s lawyer stated that Heard was clearly referring to Depp.
Depp was once a Hollywood star and said that Heard’s accusations cost him everything. Depp’s new movie “Pirates of the Caribbean”, was suspended and he was replaced by “Fantastic Beasts”, a spinoff of Harry Potter.
Heard’s legal team argued she was truthful and her opinion was free to express as it is protected by the First Amendment of the U.S. Constitution.
Depp lost his libel suit against The Sun two years ago. This British tabloid called him a “wifebeater”. Heard had been repeatedly attacked by Depp, a judge at the London High Court ruled.
Because the Washington Post is published in Fairfax County Virginia, Depp’s attorneys filed this case. The newspaper is not involved in the case.
