(Reuters) – Texas has asked the U.S. Supreme Court Thursday to preserve a Texas law banning abortion and defend it against a challenge by President Joe Biden.
The Texas Attorney General Ken Paxton replied in a legal file to the U.S. Justice Department’s request that it block immediately the state law by the Supreme Court while they continue the legal battle.
A 6-3 conservative majority of the Supreme Court allowed the law’s enforcement in an earlier challenge by providers of abortion. The Chief Justice John Roberts, a conservative chief justice, expressed doubts about the way that the law was enforced in a Sept. 1 5-4 decision.
Texas’s restrictive abortion law bans abortion after six weeks. Many women are not aware they are pregnant at this point. The exception is made for medical emergencies that are documented, but it does not apply to cases of incest or rape.
