LOS ANGELES, (Reuters) – Andrew Cuomo’s attorney suggested Saturday that the sheriff’s department in the county who filed a misdemeanor sex case against former governor of New York leaked confidential testimony from the grand jury to the media.

Rita Glavin sent a notice to Albany County Sheriff Craig Apple, (NASDAQ:) requesting all records regarding the Cuomo sheriff’s Office investigation be saved. Cuomo called Saturday’s probe “rogue”.

Apple denied Friday the allegations of Cuomo’s camp that their investigation was motivated by politics. Cuomo’s lawyer called Thursday’s criminal case “suspect” because it came on the heels of Letitia James, New York’s Attorney General, announcing that she would be running for governor.

Cuomo was accused of multiple instances sexual harassment and resigned in August. Both James and Cuomo are Democrats, but they are also political enemies. James’s Office is currently conducting an independent investigation into Cuomo.

Cuomo is charged with forcible touch by touching a female assistant under her blouse in the Executive Mansion. Although the complaint didn’t name Brittany Commisso as her victim, she identified herself as Brittany Commisso who was Cuomo’s executive assistant.

Glavin requested that Apple keep all communication between his office, that of James and state legislators, journalists, and Commisso in Saturday’s letter.

Glavin wrote to Apple, “We will be asking about an investigation of unlawful Grand Jury leaks, as well as exploring legal remedies for such losses,” Glavin said.
