(Reuters] – Blue Origin, Jeff Bezos’ space company, has rejected a federal court lawsuit against the U.S. government. The suit was over NASA awarding a lunar lander contract worth $2.9 billion to Elon Musk’s SpaceX.

The government filed a motion to dismiss its Aug. 16 lawsuit against the U.S. Court of Federal Claims. Judge Richard Hertling granted that motion. As a precaution, the opinion of Judge Richard Hertling explaining his reasoning was sealed along with many other documents from the case. This is in anticipation of a meeting between the parties on redactions.

Blue Origin was founded by Amazon.com Inc. (NASDAQ:). Bezos. It has stated that its suit is “an attempt at remedying the flaws found in NASA’s Human Landing System acquisition process.”

Blue Origin spokeswoman, responding to the decision of the judge, said that the company’s issues in the suit must still be resolved. She also cited the U.S. Space Agency’s ongoing work.

The statement said, “We are engaged with NASA to develop sustainable lander design, conduct many technology risk reductions and provide Commercial Lunar payload services.”

Blue Origin has not yet responded to our question regarding whether they will appeal this ruling.

NASA suspended work on the contract for the lunar lander until November 1, just days after it was brought to its attention. NASA claimed that the pause was part a settlement between the parties in order to speed up the litigation process, which culminated with Thursday’s ruling.

In July, the U.S. Government Accountability Office sided with NASA in its choice of a lunar lander supplier. This rejection was rejected by Blue Origin.

Blue Origin was an accusation against the U.S. government. However, SpaceX headed by Tesla Inc (NASDAQ:) Musk joined the proceedings shortly after it was filed as an intervener defendant.

NASA was seeking proposals to build a spacecraft to carry astronauts to lunar surface as part of its Artemis program, which aims to bring humans back to the Moon for the first-time since 1972.
