Arbutus Shares Rise Moderna’s Fall After Patent Appeal Denied -Breaking

Investing.com — Moderna Inc (NASDAQ:) shares fell Wednesday after the company lost an appeal on a patent ruling involving Arbutus Biopharma Corp (NASDAQ:). 

U.S. Court of Appeals Federal Circuit affirmed Patent Trial, Appeals Board, and Patent Trial decisions in respect to two Arbutus Patents pertaining to drug-delivery technology. Moderna’s appeal against the Appeals Board and Patent Trial decisions regarding drug-delivery technology was rejected by the court. This decision is upheld last year’s ruling, means Moderna could now face a patent infringement lawsuit.

Moderna shares fell 8.6% while Arbutus shares nearly doubled and are currently at 90%.

The 435 patent is one of two involved. It is described as “stable nucleic acids-lipid particles comprising nucleic acids, methods for making SNALP and methods of administering and delivering the SNALP.”

Moderna stated previously that Arbutus could sue Arbutus to recover royalties from Moderna Covid-19 vaccine if their claims are upheld.
