(Reuters] – On Wednesday, a convicted murderer sentenced to death for his killing of his pregnant wife and son in California was overturned by the California Supreme Court. He will likely be sentencing again to live imprisonment.

Scott Peterson (49) was sentenced to death in 2005 for murdering Laci his wife and seven-months pregnant with Conner.

San Mateo County Superior Court Redwood, California (NYSE:) City will give his sentence.

Birgit Fladager from Stanislaus County, who prosecuted this case, stated in a May court filing that she wouldn’t seek another death sentence because the victim’s family decided it was too painful.

Laci Peterson went missing on Christmas Eve 2002 from her Modesto, California home. It prompted a month-long investigation and search. The remains of Laci Peterson and her unborn child were washed up on the shores of San Francisco Bay in April 2002.

California’s Supreme Court dismissed Peterson’s execution sentence in August 2020. It was based on 13 jurors who were wrongly dismissed by the San Mateo County Superior Court Judge. These potential jurors had submitted an initial questionnaire and expressed their opposition to Peterson’s death penalty.

In separate proceedings, in October 2020 the state Supreme Court ordered Peterson’s trial court to review his conviction. This was based upon his argument that Peterson should have his murder charges dropped because of prejudicial misconduct committed by a jury member.
