(Reuters) – Plaintiffs who accuse Alphabet (NASDAQ) Inc.’s Google unlawfully tracking them while using “Incognito” browsing mode, can interview Chief Executive Sundar Pichai until two hours. This is according to a California Federal Judge.

Users filed a lawsuit against Google in June 2020 alleging that Google tracked their internet usage while Google Chrome was set up in “private mode”.

Plaintiffs claim that Pichai is “uniquely personal” in his knowledge of privacy and Chrome browser issues, as a court filing on Monday showed.

Google spokesman José Castañeda told Reuters the new requests were “unwarranted and overreaching”.

“While we strongly dispute the claims in this case, we have cooperated with plaintiffs’ countless requests … We will continue to vigorously defend ourselves,” Castañeda said.

In 2019, Pichai was warned by a judge that calling Incognito’s browsing mode “private” would be problematic. However, the court filed in September shows that the judge did not force Pichai to change his mind.

U.S. Magistrate Susan van Keulen of San Jose California said Monday that “a few papers establish that specific pertinent information was communicated [to, and possibly from], Pichai” and supported an order from plaintiffs’ lawyers for him to be questioned.

Google stated earlier that Incognito does not prevent data being stored on a user’s devices. It is also fighting the suit.

In light of growing concerns over online surveillance, the privacy disclosures made by Alphabet have attracted regulatory and legal attention in recent years.
