NEW YORK, (Reuters) – A U.S. Judge dismissed Monday’s federal government criminal case against Manhattan jail guards. They admitted falsifying records the night Jeffrey Epstein died during their shifts.

After prosecutors stated that Michael Thomas and Tova Noel had complied to the six-month delay in prosecution agreement, U.S. District Judge Analisa Torres dismissed their claims.

Epstein committed suicide in his Metropolitan Correctional Center cell on August 10, 2019 while waiting for trial on charges of sex traficking.

Thomas and Noel were charged with falling asleep, surfing the web that night and not checking Epstein’s status every 30 minutes. They also admitted to falsifying records in order to appear they were properly monitoring Epstein.

Both agreed to cooperate with the federal probe into Epstein’s death. William Barr was the U.S. Attorney General at that time. He had become angry about Epstein’s suicide while in federal custody.

Jason Foy, Noel’s attorney, stated that the case was handled differently by government officials because Epstein is “infamous”. He also said his client had cooperated with the government by sharing information about the “toxic culture”, subpar training and staffing shortages and the dysfunctional management of the jail.

Thomas’ lawyer stated last week that Thomas was pleased the case had been dismissed and that he was looking forward to moving on with his life.
