NEW YORK (Reuters). Britain’s Prince Andrew will request that a New York judge dismiss Virginia Giuffre’s lawsuit against him alleging that he abused her sexually as a minor and that she was also trafficked by Jeffrey Epstein.
U.S. District judge Lewis Kaplan is scheduled to review a November 2009 settlement agreement among Epstein (61-year-old prince) and Giuffre. Andrew claims that the deal protects him from Giuffre’s claims.
Giuffre claims Andrew forced Andrew to have sex with her when she was 17, at the London home Ghislaine Maxiwell. Andrew also abuses her at two Epstein properties. He has never been charged with criminal wrongdoing.
In 2009, the agreement contained a general release which would “forever disengage” people that could have been “potentially defendants” in a Florida civil lawsuit Giuffre had brought against Epstein. Epstein was also a Florida resident.
The settlement agreement did not identify any person by name. Epstein was to pay Giuffre $500,000 without admitting liability under the settlement agreement, which was made public https://www.reuters.com/world/us/prince-andrew-accusers-deal-with-epstein-be-made-public-part-civil-suit-2022-01-03 on Monday.
Kaplan won’t rule right away during Tuesday night’s oral argument, which will take place remotely.
Andrew also accuses Giuffre, who she claims is seeking another “payday,” in her campaign against Epstein as well as former associates such Maxwell. Maxwell sought $50m in a settled 2015 defamation suit.
He is represented by Andrew Brettler, a Los Angeles lawyer, while Giuffre is represented by David Boies of Boies Schiller & Flexner.
Boies Monday stated that Andrew is not covered under Giuffre’s settlement as Andrew could not be sued in Florida. The case did not concern Andrew.
Andrew’s ties to Epstein have cost him many royal duties and damaged his reputation, including after critics said he failed in a 2019 BBC interview https://www.reuters.com/article/us-britain-royals-andrew/britains-prince-andrew-categorically-denies-sex-claims-idUSKBN1XP2CX to appear sympathetic to Epstein’s abuse victims.
Kaplan stated that Giuffre’s case against Andrew may go before a judge in September or December, if there is no agreement.
Epstein, 66 years old, committed suicide in Manhattan prison cell while waiting for his trial on charges of sex trafficking.
Maxwell, 60, was convicted https://www.reuters.com/world/us/maxwell-jury-resume-deliberations-after-judge-warns-omicron-risk-2021-12-29 on Dec. 29 of recruiting and grooming girls for Epstein to abuse between 1994 and 2004. Giuffre was not a part of the case and did not testify.
