WASHINGTON (Reuters) -The U.S. Supreme Court on Thursday blocked President Joe Biden’s pandemic-related vaccination-or-testing mandate for large businesses at a time of escalating COVID-19 infections while allowing his administration to enforce its separate vaccine requirement for healthcare facilities.
After hearing the arguments in the legal battle over two temporary mandates that were issued by federal agencies in November, they had to act. These mandates were intended to increase vaccination rates in America and make healthcare environments and workplaces safer. In both instances, the court split. In both cases, the court ruled in favor of the employer ruling 6-3. The majority was composed of six conservative justices and the three liberal justices. It was 5-4 in favor of allowing the rule for healthcare workers, with Justice Brett Kavanaugh and Chief Justice John Roberts joining liberals.
Federal workplace safety agency published a rule that affected businesses employing at least 100 people who require vaccines and weekly COVID-19 testing. This policy applies to over 80 million workers. After an injunction was lifted by a lower court, a group of businessmen and the state of Ohio challenged the Occupational Safety and Health Administration’s (OSHA), rule. On Monday, companies were to begin showing that they are in compliance.
An unsigned ruling stated that OSHA’s rule was not an usual use of federal power.
The court stated that “it is rather a significant invasion on the lives and health of a vast amount of employees.”
Justice Stephen Breyer, speaking for the liberal justices, stated that COVID-19 is a “unprecedented threat” to workers and that it was stopping the federal government from responding to that danger.
A Dec. 17 Cincinnati-based 6th U.S. Supreme Court decision was blocked by the high court. Circuit Court of Appeals, which had granted the mandate to take effect.
It is possible that the order by the court blocking enforcement, while litigation continues at a lower court, signals death for administration’s attempts to increase vaccine numbers through harnessing federal power to ensure workplace safety and health. The legality of this approach was questioned by conservative justices during oral argument.
Another mandate called for vaccination of an estimated 10.3 millions workers in approximately 76,000 health care facilities, including nursing homes and hospitals that take money from Medicare or Medicaid. This includes those who accept funds from low-income Americans and people with disabilities.
Federal judges from Missouri and Louisiana had blocked the policy in 24 states. The court lifted these orders, which allowed the administration to apply it almost nationwide. A lower court, in separate litigation that was not involved in this case against the Supreme Court, blocked enforcement in Texas.
The mandate requires that workers be immunized by February 30th.
