U.S. Supreme Court won’t review decision freeing Cosby from prison

Monday’s Supreme Court decision that it would not consider the sexual assault case against Bill Cosby was a rejection of a Pennsylvania court ruling. This left in place an earlier Pennsylvania Supreme Court decision to overturn his conviction and release him from prison.

Cosby was convicted and the High Court declined to grant prosecutors a hearing. Pennsylvania’s Supreme Court rescinded Cosby’s conviction last year, stating that the prosecution who filed the case had to abide by the agreement of his predecessor not to indict Cosby.

It was typical for the Supreme Court to not comment on the rejection of the case. This case was among a number of other cases that the Supreme Court said it wouldn’t hear Monday.

Cosby was aged 84 when he was found guilty in 2018 by a jury of sexually assaulting Temple University employee Andrea Constand. Cosby had been convicted of sexual assault in the #MeToo era. A mistrial was ordered in 2017 after a jury failed to reach a verdict.

Cosby was in prison for nearly three years before the Pennsylvania high court released him.

Unless they consent, the Associated Press will not normally identify victims of sexual assault unless they give permission. Constand did so.
