Amazon sued by warehouse workers over COVID-19 screening pay By Reuters

(Reuters: Amazon.com Inc. (NASDAQ) is being accused of violating Colorado state laws by refusing to pay warehouse workers time spent undergoing COVID-19 screens before they clock in at work.

Jennifer Vincenzetti worked in two Amazon warehouses in Colorado Springs. On Tuesday, she filed a class action proposal in Colorado federal Court. She claimed that the company required workers to wait for long lines in order to get their temperature checked and answered questions.

Amazon, based in Seattle, did not respond immediately to our request for comment.

This proposed class includes over 10,000 individuals at five Colorado warehouses.

David Seligman from nonprofit Towards Justice stated in a statement that Amazon appears to have made every effort to ensure the safety of its employees, provided the workers pay the cost.”

According to the complaint, Amazon began requiring employees in Colorado’s warehouses to report early and wait outside for their turn. Once inside, they would then be able answer questions and verify that the temperature was correct. According to the lawsuit, this process took between 20 and 60 minutes.

Colorado law makes this time compensable. It states that workers are entitled to compensation if they have to be present on the premises of their employer or performing duties.

Amazon argued that the screenings, which primarily benefit workers and do not count as compensable time under federal wage laws in California Federal Court.

Walmart (NYSE:] has also raised this defense in Arizona’s proposed class action. The retail giant claimed that its failure to compensate employees for their time in COVID screenings was a violation of Arizona state law.
