Epic Games opposes Apple’s effort to pause antitrust trial orders -Breaking

(Reuters) – Epic Games, the creator of “Fortnite”, has reacted against Apple Inc (NASDAQ)’s attempts to place hold orders in an antitrust case as a potential lengthy appeals process.

U.S. district Judge Yvonne Gonzalez Rogers (NYSE:) in September struck down https://www.reuters.com/article/apple-epic-games-idTRNIKBN2G61IK some of the iPhone maker’s App Store rules, including a prohibition on developers directing their users to other payment options beside Apple’s in-app payment system, in a partial win for Epic and other app makers.

Apple is required to obey the injunction before Dec. 9. However, Apple earlier this month stated that it intends to appeal the decision and Gonzalez Rogers asked her to suspend the order while she appeals the process which could last more than one year.

Epic claimed Friday that Apple did not meet the legal standards for the pause. The law requires that Apple prove that Apple will suffer irreparable harm if it does comply temporarily with an injunction.

Epic claimed that Apple’s comments regarding the ruling, shortly after it was landed, as well as its delay in asking to pause the process, proved that the order would not cause any harm.

Epic stated that the public interest favours Apple’s denial of its request. An injunction, however, is the best way to obtain effective relief. History has shown that Apple won’t make any changes if there is no injunction.

Apple didn’t immediately reply to our request for comment.

November 9th will see a hearing about Apple’s request.
