WASHINGTON (Reuters] – Former President Donald Trump attempted to withhold documents from lawmakers probing the attack on the U.S. Capitol Jan. 6. He was stopped by U.S. Vice President Joe Biden and directed that the most recent batch be given to Congress.

Biden wrote to Dana Remus in an Oct. 25 email to the National Archives and Records Administration, stating that he had concluded that asserting executive privilege was against the United States’ best interest and is therefore not justifiable.

Taylor Budowich (a Trump spokesperson) did not respond immediately to our request for comment.

An investigation is underway by the U.S. House of Representatives into Trump supporters’ Jan. 6 attack on Congress. They wanted to prevent lawmakers from certifying Biden’s win. Nearly 700 individuals now face criminal prosecution after the attack, which saw five people killed.

Biden was a Democrat and blocked Trump from obtaining the initial tranche of documents relating Jan. 6, 2016, when he still held office as a Republican President. Trump filed a lawsuit.

The White House informed the federal archivist in both instances that Congress needed to understand the “most serious attack” on federal government operations since the Civil War.

Biden requested that the archive provide all the documents within 30 days of notifying Trump, citing the urgent nature of his request.

A number of people, including Trump’s top aides or allies, are being asked to testify by lawmakers. Steve Bannon is the one who has declined to testify, citing Trump’s executive privilege claim. He could be facing criminal charges.
