Ferrari wins EU court backing in rights spat with German car designer -Breaking

BRUSSELS, (Reuters) – The dispute between Ferrari and a German design firm was settled by the European Supreme Court. It argued that Ferrari owns all rights to the Ferrari FXX K race car’s appearance.
The case could have wide-ranging implications across a range of industries. This includes luxury brands looking to protect their designs against imitations as well as manufacturers of complicated products that are made up many parts.
After a German court requested guidance regarding a dispute between Ferrari and Mansory Design, a Luxembourg-based Court of Justice of the European Union ruled in favor of Mansory Design.
It is the Ferrari FXX K’s V-shaped bonnet and front bumper that are in dispute.
Ferrari filed a lawsuit against Mansory Design before the German court, claiming that the accessory made to transform the Ferrari 488 GTB into a $2.6 million Ferrari FXX K was illegally sold and manufactured by the company.
CJEU stated that a component could be considered an individual part and have design rights provided it is clearly identifiable by specific lines, contours or colours.
