(Reuters] – Republican governors plan to sue the Biden Administration Friday for stopping its requirement that employers in America get their workers tested or vaccinated with COVID-19. The administration has been accused of violating civil liberties.

On Thursday, President Joe Biden (a Democrat) said he would implement the mandate from Jan. 4. Florida Governor Ron DeSantis announced that he would join governors in Georgia and Alabama, as well private plaintiffs, to file suit.

DeSantis stated at a press conference that “the federal government cannot unilaterally impose health policy in the guise workplace regulation.”

In addition, Nebraska’s Republican governors from Indiana and Iowa vowed that they would challenge this decision in court.

OSHA or Occupational Safety and Health Administration was the federal regulator of workplaces and this regulation was made as an emergency rule.

“Biden just declared his plan to use OSHA for vaccines on private business,” Texas Attorney General Ken Paxton wrote (NYSE:) Thursday. I’m going to sue him if this unconstitutional, illegal regulation is published in the Federal Register.

Texas is among Republican-led states that have issued executive orders and enacted laws banning COVID-19 vaccination mandates. Employers are also prohibited from asking employees about their immunization status.

OSHA declared that this rule has precedence over any conflicting laws from other states. The rule will be effective Friday, when it is scheduled to be published in federal register.

At least two lawsuits were initiated against the mandate on Thursday, one by Phillips Manufacturing & Tower and Sixarp LLC and the other by Bentkey Services LLC, which owns The Daily Wire, a conservative media company. They were both filed at the U.S. 6th U.S. Circuit Court of Appeals, Cincinnati.

A senior OSHA official responded to critics of the rule by saying that OSHA has clear authority to take action to safeguard workers against safety and health hazards. COVID-19 is responsible for the deaths of more than 750,000 people in America.

Biden stated in September that it was becoming increasingly difficult to be patient with the remaining 30% of Americans unvaccinated. They also made up the majority of the COVID-19-infected hospitalized.

The use of Mandates by local government and private companies to raise COVID-19 vaccinations rates has been supported by courts. This is because the states have the authority to control healthcare in their own borders.

Numerous opponents have indicated their intent to sue. OSHA’s Emergency Rule has been repeatedly blocked in court.

Even if the court upholds the mandate, certain states may not apply the rule.

OSHA covers private work places in 29 US states. Indiana, Iowa and other states have OSHAs that are run by their state governments. These OSHAs must then adopt the federal rules.

OSHA published a COVID-19 similar rule regarding healthcare setting in June. In October, the federal agency threatened OSHA state agencies in Arizona, South Carolina, and Utah with taking over their OSHA offices for not adopting it. South Carolina and Arizona have both since stated that they are in the process of adopting the rule. Utah officials did not reply to our request for comment.
