ZURICH (Reuters). Swiss Federal Prosecutors are about to end a five-year-old criminal investigation into Volkswagen’s (DE:) diesel emissions scandal. They concluded that they didn’t have enough evidence to bring charges.

In a statement, the Office of the Attorney General stated that it had sent information to the German automobile maker and the Swiss branch of the dealership in this month. It also confirmed a SRF report.

It stated that the defendants and the private plaintiffs could still examine the case files and present additional evidence, before it is officially closed.

VW admits in September 2015 to having installed secret software in US diesel cars in order to cheat emission tests. This made the vehicles appear cleaner. There could be as many as 11,000,000 such software installations worldwide.

After a court ordered that they conduct an investigation on hundreds of complaints filed in Switzerland, Swiss prosecutors initiated criminal proceedings.

This case concerned the possible damage to approximately 175,000 VW Group customers who purchased or leased vehicles of VW Group with diesel engines that, at most, some VW officials had to have suspected were manipulated.

SRF claimed that Swiss plaintiffs can still sue for damages in civil law. It noted that VW has paid billions overseas. It added that “but without official culprits such proceedings in Switzerland can be very expensive and difficult for individuals.”

VW did not respond to Reuters’ Tuesday inquiry.
