On Wednesday, a federal judge rejected the emergency request by former President Donald Trump to prevent a number of White House records from being handed over to lawmakers who were investigating the Jan. 6 Capitol Invasion.

For those records to be withheld, the legal team of the ex-president will appeal to an appels court.

It was one day after U.S. Circuit Judge Tanya Chutkan had denied Trump’s two separate attempts to stop the release the disputed records from the House select committee that conducted the investigation.

Chutkan rejected Trump’s Tuesday night request that the National Archives not give House investigators a tranche containing records from Trump’s tenure in the White House.

Jesse Binnall (Trump’s lawyer) argued that most of the documents should remain secret because they are protected under executive privilege. Executive privilege is a doctrine which allows executive branch dealings to remain private. President Joe Biden refused privilege to the documents in dispute.

A 39-page opinion by the judge said that Trump’s viewpoint “appears to rest on the idea that his executive powers ‘exist in perpetuity.’ However, presidents aren’t kings and Plaintiff isn’t President.

The decision was made hours after Chutkan rejected Binnall’s request for an emergency injunction. This ruling will be appealed to the U.S. Court of Appeals. Circuit.

That request was rejected by the judge because of procedural reasons.

Trump’s lawyer filed an appeal notice less than one hour after Chutkan had ruled Tuesday night.
