American, JetBlue seek dismissal of antitrust lawsuit tied to partnership

American Airlines and JetBlue AirwaysA U.S. judge was asked Monday to throw out a lawsuitThe Northeast partnership of six carriers was the subject of a lawsuit by the Justice Department, six states and five other countries.

In September 2009, a lawsuit was filed in Massachusetts federal court alleging that Northeast Partnership airlines violate antitrust laws. This would result in reduced competition within the region, higher airfares, and worse service quality.

The partnership allows American Airlines and JetBlue to sell their flights together in the Northeast U.S.A, which includes the congested New York City and Boston airports. JetBlue and American Airlines said Monday that JetBlue and the Justice Department have not shown the Alliance has hurt competition or raised fares. The lawsuit should therefore be dismissed.

According to the airline, “The NEA was in place for nine months. Yet, Plaintiffs don’t allege it has resulted in any higher prices, reductions in quality, or even the slightest drop in output.”

The Justice Department has not yet commented.
