Amazon seeks to pause antitrust review of 2019 deal with India’s Future, documents show -Breaking

NEW DELHI, (Reuters) – Amazon.com Inc (NASDAQ) asked India’s Supreme Court for a pause in an expedited review. The Supreme Court was concerned with allegations that Amazon.com Inc (NASDAQ) concealed information when it sought antitrust clearance to enter into a deal with India Future Group. Legal papers seen by Reuters revealed this.

In June, the Competition Commission of India (CCI), accused Amazon of hiding facts and making false submissions as it applied for approval to invest $200 million in a Future unit in 2019. This deal is currently at the center of long-running legal disputes between both sides.

Amazon stated to Reuters that at the time it was certain of addressing concerns raised by the watchdog.

Amazon has adopted the Supreme Court approach. This was after the CCI hosted a closed-door meeting on Wednesday. The U.S. attorneys declined to defend and explain their positions on the matter. They had asked for a pause in the proceeding.

In an internal document, the watchdog stated that it decided not to extend its time to companies to clarify its position. Reuters was able to see this document.

Amazon and CCI have not yet responded to requests for comment.

Amazon’s legal issues are critically affected by the CCI ruling. People familiar with the matter say that if the CCI decides against Amazon, and cancels its 2019 approval, this could have broad-ranging consequences for the ongoing U.S. legal battle with Future.

This is because Amazon used the 2019 Future unit agreement to successfully argue breach of contracts. Last year, when Reliance Industries announced its plans to buy Amazon’s retail assets for $3.4billion, Amazon was successful.

Future denies wrongdoing and accuses Amazon for illegally interfering with its business decisions. Future also claims that Amazon steered away from a deal it was considering. Future says it is going to liquidate the company without it.
