(Reuters) – Tuesday’s federal court ruling prevented the U.S. government in Kentucky, Ohio, and Tennessee from enforcing a COVID-19 vaccine mandate. This is the second setback to the Biden administration’s vaccination policy.

To end the pandemic, the White House cannot enforce a rule that requires new contracts for government to contain clauses that mandate that all employees of contractors be immunized against coronavirus.

Can the President use the congressionally-delegated authority to oversee the Federal Procurement of Goods and Services to immunize federal contractor and subcontractors employees? Gregory Van Tatenhove (U.S. District Court) in Frankfort. “In all probability, that answer is no.”

Three states brought together the suit, which was one of 13 nationwide filed against the regulation. However, it seems to have been the first to result in a ruling.

A federal judge in St. Louis blocked Monday’s Biden Administration rule that insisted healthcare workers in 10 states get COVID-19 vaccinations. The judge found the government had exceeded its authority.
