Jurors in Holmes trial remain deadlocked on three of 11 fraud counts

SAN JOSE, Calif. — Hours after Judge Edward Davila ordered jurorsThey are still locked in a criminal case against Elizabeth Holmes, which will continue deliberating on the three criminal fraud cases facing Theranos founder.

Davila received a second jury notice at 2:40 PM PT Monday. This was three hours after Davila gave the Allen charge to jurors. It instructed them to try harder to reach a unanimous decision.

Davila sent the jurors back by Davila to reach a verdict on eight additional counts, provided they are ready.

The deliberations lasted more than 50 hours in seven days. The jury was handed the case on Dec. 17, following a three-month trial that featured 32 witnesses, mostly called by the prosecution. Holmes, 37 years of age, was Holmes’ primary witness.

Holmes and her family, including her father, Billy Evans, were back in San Jose, California on Monday to see the courthouse. Holmes was also accompanied by some of her friends.

Holmes was Holmes’s first appearance in courtroom on the morning of her initial appearance. since Dec. 23The jury had not yet indicated that they were carrying Davila’s note. Holmes has been staying at the hotel just across the street, and only comes to the courtroom when the notice for the judge is posted.

This is the fourth and third times jurors have written a note to Davila. On was the first. Dec. 21When they were asked by Davila if they could send instructions back for them to review, they declined. Davila refused to grant their request and stated that all discussions must be held on site. They asked for audio from the conversations Holmes had with investors during her trial and two days after that.

Davila gave the jury instruction number 2. earlier Monday. The jury was given instruction No. 2 by Davila. This instruction reminded Holmes that he is innocent until proven guilty. The government bears the burden.

The last meeting of jurors was held on Wednesday. After failing to find a consensus, they took the remainder of the week off in order to celebrate the new year.

Holmes is facing up to 20 year imprisonment if she is convicted of nine wire fraud charges and two conspiracy to commit wirefraud. Holmes has pleaded guilty.
