Novartis says U.S. court upholds Gilenya patent -Breaking

REUTERS/Arnd WiegmannZURICH, (Reuters) – Novartis AG announced Tuesday that a U.S. appeals court upheld the legality of a dosage-regime patent for the multiple sclerosis treatment Gilenya. The permanent injunction against HEC Pharma in China will remain in effect until the patent expires 2027.
The statement by the Swiss drugmaker stated that the decision “confirms the validity and allows for the injunction” and added that it expects no generic Gilenya versions to be available in the U.S. Market in at least two years.
HEC was rejected Monday by the U.S. Court of Appeals Federal Circuit. The panel separated and rejected HEC’s arguments that the patent did not contain a written description. It threw out the company’s attempts to make a generic Gilenya product before its patent expires.
