Oxylabs Alleges Competitor Bright Data Patent Infringement

Oxylabs has filed legal proceedings against Bright Data as a proxy service and data collector provider. Bright Data claims that Bright Data violated three Oxylabs patents. These legal actions continue a long-running legal battle between these parties.

Bright Data, then Luminati Networks (now Luminati Networks), filed patent infringement lawsuits against Oxylabs a few years ago. They had alleged that the use of Oxylabs’ residential proxy network and Real-Time Crawler (now split into 3 separate products) was infringing upon their patents.

With the hopes that both companies would settle their disputes outside of court and the cases between them being referred to mediation, Oxylabs turned things around with the latest patent case. It showed that this could be just the beginning.

A second case is on file

Notwithstanding its non-patent nature complaints, Oxylabs hadn’t previously filed any patent infringement lawsuits. According to a press release, Bright Data is being tested. Presumably, they infringed three Oxylabs patents.

Smart Proxy Rotator, and web script management are the technologies at issue. Bright Data and Oxylabs both have direct involvement in both automated data acquisition (proxies) and Oxylabs. The former also alleges that Bright Data has been selling services using the above patented technologies.

This claim by Oxylabs follows the partial end of the earlier case, which was filed in Texas Eastern District Court. Bright Data received a favorable jury verdict that confirmed some of their patent rights had been violated. The verdict has ordered Oxylabs to repay monetary damages. However, the jury verdict must be approved by court. Further appeals are possible.

Even though mediation is being suggested as an option to settle differences between parties, complete resolution appears unlikely. The business models of the companies are dependent on all technologies mentioned in the three previous lawsuits.

Bright Data has remained silent while Oxylabs released a statement outlining the company’s current position. According to Oxylabs’ CEO, Bright Data needs to respect their patent portfolio. They believe the ongoing lawsuits and other market players against Bright Data threaten fairness.

IP (address) law in question

The companies share close relationships with other businesses in IP address technology. Bright Data was then known as Luminati. It held a majority share in HolaVPN, which came under criticism for possible unprofessional use of customers bandwidth. Hola VPN could have used residential proxy endpoints to bypass consenting users, according to some reports.

Oxylabs filed the case in the metacluster LT legal entity. The company previously was involved with several Bright Data lawsuits. Oxylabs has been linked to Tesonet as an investor in various online services.

These companies as well as most of the businesses they associate with are all vying to be dominant in this market. However, there are smaller companies in the proxy market such as Smartproxy and IPRoyal.

The smaller companies might face litigation if they are found to be valid. Bright Data sued Oxylabs’s competitors with similar claims.

Although the landscape is complex, proxy systems have gained popularity. Companies that need to automate data collection, or monitor the internet are often using proxy services.
