(Reuters) – Amazon.com Inc. (NASDAQ:) could soon be sued by a U.S. labor Board for unlawfully firing a union supporter in New York during an organizing campaign.

In an email, Kayla Blado (board spokeswoman) stated that a Brooklyn National Labor Relations Board official recently concluded that Daequan’s claims had merit. If Amazon does not settle the case, she will file a complaint.

Bloomberg was the first to report on this development.

Amazon didn’t immediately reply to our request for comment.

Amazon’s new lawsuit would be fuelled by claims from labor organizations and advocacy groups, that Amazon uses illegal tactics to stop unionization while putting profits above worker safety.

An official of the NLRB found Amazon had illegally interfering with a union election in an Alabama facility. The workers overwhelmingly voted for unionization. At the end of March, we will see how the results of another election.

Smith was employed at the Amazon warehouse on Staten Island in New York. This is also the subject of an earlier petition that a group employees filed. Smith, according to a November fundraising campaign was rendered homeless following his firing.

While the NLRB can reinstate union-related workers and compensate for their lost work, it cannot award any other damages.
