(Reuters] – An employee at a smoothie shop in Connecticut was accused of throwing a drink and an insult about an immigrant worker. This is the same man who was facing a hate crime accusation and his job has been terminated.

James Iannazzo (48) is captured yelling at young women at Fairfield shop, which is 50 miles (80km) north of New York City. He demands to know the source of his son’s peanut butter smoothie.

He is told by the employees that they don’t know who created it and asked to go. Iannazzo throws the smoothie at one employee, hitting her on the shoulder. He then tries to get into an employee-only zone and calls the woman “immigrant loser”.

Fairfield Police Department reported that Iannazzo, who turned himself in on Saturday over the incident, was taken into custody and had been charged with intimidation basing on bias or bigotry and breach of peace. According to the Fairfield Police Department, he will appear before the court on February 7,

Frank J. Riccio II is Iannazzo’s lawyer. His client made it clear to the employees of Robeks’ smoothie shop that his order would not contain peanuts.

Riccio explained that Robeks’ smoothie caused a severe allergic reaction in his son, which necessitated transport by ambulance to the hospital.

Riccio stated, “Mr. Iannazzo’s parental instinct kicked into and he was driven by anger and fear”. Riccio concluded that Riccio’s client isn’t racist and that it deeply regrets the behavior.

Bank of America (NYSE): A spokesperson for Merrill Lynch, the parent company of wealth management company Merrill Lynch, stated that Iannazzo had been employed as a financial advisor by their company. “Our company doesn’t tolerate this type of behavior… The individual in question is no longer working for our company.

(This story has been retold to clarify that Bank of America spokespeople provided comments, which corrects Iannazzo’s age.
