(Reuters] – The U.S. bankruptcy court is set to begin considering Grupo aeromexico SAB de CV’s proposal for a reorganization plan. This will be in response to junior creditors who feel they have been treated unfairly during a lengthy hearing.

Aeromexico has filed Chapter 11 bankruptcy protection in New York. In June 2020. It will appeal to U.S. Bankruptcy Judge Shelley Chapman. His proposal would provide new capital for the company. Apollo Global Management, NYSE:, would be the largest shareholder.

Although the airline claims it has secured the financial support from multiple creditors groups, others still believe the plan shouldn’t be approved. This is because junior creditors may not see the same dollar as senior creditors and should receive higher recoveries.

Chapman is allowing for several days so that she can hear all the arguments. She will probably not make a decision on the plan until Thursday. Aeromexico, which was one of three large Latin American airlines that declared bankruptcy during the pandemics, would be eligible to leave bankruptcy if the judge approves.

According to the airline’s plan, it would lower its debt by $1.1 billion and preserve around 13,000 job opportunities. Junior creditors claim it’s too beneficial for existing shareholders (including Delta Air Lines Inc. (NYSE:), and the four members of its board) at their expense.

The four Mexican men and Delta are expected to retain some equity in the newly reorganized business. Delta is likely to retain around 20% of company stock after restructuring. This is to ensure that Aeromexico has a long-term relationship.
