NEW YORK (Reuters] – Monday saw a U.S. jury resume deliberations on a defamation case against The New York Times by Sarah Palin. Palin was the former Alaska Governor and Republican U.S. vice president candidate. This case is seen as a test to the longstanding American media rights.

Palin filed suit against the newspaper’s former editor James Bennet. She argued that an incorrect 2017 editorial linked Palin to a 2016 mass shooting which left Gabby Giffords, Democratic U.S. Rep., seriously injured.

The jury deliberated on Friday for approximately 2-1/4 hours without coming to a decision. Eight days have elapsed before the trial at Manhattan Federal Court, U.S. District Judge Jed Rakoff.

Rakoff expressed concern after Monday’s deliberations resumed. A lawyer representing the Times said that Project Veritas was uploading video depositions from two witnesses to the trial.

Rakoff claimed that the internet posting wouldn’t be an issue if jurors didn’t obey his request not to view such material.

In court it is not common for major media outlets to defend their editorial practices, such as in the case of The Times.

Palin said she would appeal New York Times v. Sullivan if she loses the trial. It was a 1964 U.S. Supreme Court ruling that established the “actual malice” standard to determine defamation.
