WASHINGTON, (Reuters) – The White House announced Monday that it would not grant executive privilege to former President Donald Trump’s advisors. This testimony was being sought by a Congressional panel investigating the Jan. 6th 2021 Capitol riot.

A White House lawyer informed Peter Navarro, a former Trump trade adviser and Michael Flynn’s lawyer, in letters dated February 28, that President Joe Biden determined executive privilege was not “in the national interest” and that it therefore could not be justified in some matters before the committee.

Jonathan C. Su was the Deputy White House Counsel and wrote two separate letters about the case. These subjects included events within the White House, attempts to use Department of Justice to promote a false narrative suggesting that the 2020 election had been tainted with widespread fraud, as well other attempts to manipulate election results and block the transfer of authority.

Flynn’s lawyer and Navarro did not respond immediately to Axios’s requests for comment.

Trump has asked his associates to not cooperate with the committee. He called the Democratic-led investigation political motivated. Trump also argued that executive privilege protects his communications, even though many legal professionals have stated that the same legal principle doesn’t apply to ex-presidents.

Trump supporters stormed Capitol Jan. 6 in an attempt to block Congress’ formal certification of his 2020 loss to Biden. Just before the Riot, Trump addressed his supporters and repeated his fraudulent claims about the election being stolen through fraud. He urged them to “fight like hell” and go to Congress.

Flynn was summoned to testify and provide documents by the committee in November.

Flynn encouraged Trump to use the military to reverse the election results in the following weeks and made speeches to cast doubts on the outcome of the election. Flynn brought suit against the congressional panel investigating Jan. 6’s attack, in an attempt to block it from getting his phone records.

This month, the committee revealed that it had subpoenaed Navarro. He was a crucial player in Trump’s efforts to reverse his defeat.

According to the House of Representatives, it requested records from Navarro and testimony by deposition. Navarro was part of efforts to derail Congress’s certification of 2020 elections.
