BEAUMONT (Reuters). -The United Steelworkers Union (USW), won a vote for continued representation of workers at an Exxon Mobil Corp (NYSE 🙂 is an oil refinery that operates in Beaumont Texas. The U.S. National Labor Relations Board announced Monday.

It ends the bitter dispute over whether plants that have been unionized since the 1940s will end their union to bring an end to a lengthy lockout. As non-union businesses Apple (NASDAQ), Starbucks (NASDAQ), and Amazon.com are facing organizing drives, the decision to stay in union is made.

In November and December, nearly 500 employees of refineries participated in the vote. According to the NLRB, opposition to the union did not reach the minimum 50% and one vote required to eliminate the USW.

The labor board will not officially declare the results. Both sides can file objections within seven days.

According to the NLRB, certification will only be granted after an investigation is completed by Exxon’s USW on unfair labor practice allegations. This has not been scheduled.

Exxon asked last week the NLRB for the release of the ballots in accordance with rules by the board that limit the period during which the ballots can be impounded to sixty days.

Exxon spokesperson stated that employees voted for the United Steelworkers and will be represented therein.

Workers who opposed USW representation voted 229 out of 487 votes, according to the NLRB. That’s 15 less than what was required for the removal of the union. Nine ballots weren’t counted as they were either late or improperly signed.

Officials from USW Local 13-244 stated that “as expected and despite Exxon Mobil’s best efforts at dividing the members of USW 13-243 over more than 10 years of lockout”, the NLRB counted decertification ballots to prove the strength of the membership.”

After talks that failed to produce a new labor deal, union workers were expelled from the plant in May. The 6-year-old contract was ratified by the union workers and they were able to return to work on this month.

USW claims Exxon’s lockout was designed by the USW to promote the removal of the union. Exxon claims that the accusations are baseless.
