WASHINGTON (Reuters] – A New York prosecutors leading a probe into Donald Trump’s business activities and criminal behavior said last month in a resignation that Trump is guilty of many felony violations. The New York Times reported Wednesday.

According to the Times, Mark Pomerantz resigned after Alvin Bragg, Manhattan District Attorney, indicated that he was unsure about filing a case against Trump. He also stated it was a “grave failure of justice not to hold Trump responsible.”

According to Pomerantz’s letter, “The team that has investigated Mr. Trump harbours no doubt whether he perpetrated crimes – it did”, Pomerantz said. The Times published the letter.

Criminal defendants in the United States are presumed innocent, unless they can be proven guilty beyond reasonable doubt.

Bragg’s predecessor Cyrus Vance had said in court filings that the office was investigating “possibly extensive and protracted criminal conduct” at the Trump Organization, including tax and insurance fraud and falsification of business records.

Pomerantz has not yet responded to Reuters’s request for comment. Ron Fischetti, Trump’s lawyer, did not reply to the request for comment. The Trump Organization and its lawyer Alan Futerfas did not respond to any requests for comment immediately.

According to The Times, Fischetti said that Trump was not entitled to be charged and praised Bragg for not proceeding with the case.

Carey Dunne (another prosecutor) resigned in the same day that Pomerantz. The Times reported that Bragg took office Jan. 1 and was not sure the prosecutors could prove Trump intended to overvalue his real property.

Danielle Filson (Bragg’s spokeswoman) told the Times that an investigation was underway.

New York Attorney General Letitia Jam is conducting a civil investigation into Trump Organization and Trump.

Trump previously claimed that he had never committed any wrongdoing, and that the city and state investigations were political motivated.
