CNBC reached out to the Supreme Court spokesperson for comment on Thomas’s statement and that of Chief Justice John Roberts.

Thomas, in January, was the only justice to dissent in the ruling that denied Trump’s efforts to block hundreds of pages from presidential records being handed to the House committee investigating the Capitol Riot.

Thomas was one of three conservative justices who voted against the Supreme Court’s February 2021 decision not to appeal lower court rulings that allowed Pennsylvania absentee votes to be counted within days of Election Day 2020.

Trump lost Pennsylvania as well as several swing states to Biden. Trump has since falsely claimed that he was a victim of widespread voter fraud.
