NEW YORK (Reuters] – Devin Nunes is a former California congressman, and an ally to former U.S. president Donald Trump. There are reports that he participated in the investigation of damaging Ukraine-related data about Joe Biden.

On Thursday, Nunes lost 2-1 to the United States. Circuit Court of Appeals, Manhattan, ruled that Nunes did not seek a corrective action fast enough or prove that he deserved special damages for economic losses.

Circuit Judge William Nardini stated the trial judge had “not erred” in concluding that Nunes violated California law concerning retractions. His $435 million lawsuit should therefore be dismissed.

CNN is a Warner Bros Discovery Unit (NASDAQ:) Inc.

Nunes’ lawyer did not respond immediately to inquiries for comment. CNN did not respond immediately to similar requests.

Nunes filed suit over a Nov. 22, 2019, article saying that Lev Parnas was an associate under former Trump lawyer Rudolph Giuliani and would testify in Congress. Nunes had met with a Ukrainian prosecutor in 2018 to talk about “digging up dirt” on Biden (a Democrat, now U.S. President).

Former Republican Congressman objected also to CNN’s “Cuomo Prime Time,” in which the host Chris Cuomo and reporter Chris Cuomo talked about their alleged involvement in finding dirt on Biden, his son Hunter.

Nunes refuted the allegations, claimed that his reputation had been damaged and called CNN “the mother fake news”

Circuit Judge Steven Menashi disapproved of Thursday’s decision. He stated that Nunes’ claims were governed by the New York laws, which Cuomo and the reporter worked in.

Trump appointed all three of the judges to the panel for appeals courts.

In recent years, Nunes sued multiple news agencies.

A federal appeals court in Washington upheld Nunes’ $250 million lawsuit. Nunes claimed the Washington Post had defamed Nunes by suggesting that he lied about Trump’s attendance at an intelligence briefing regarding Russia.

Nunes left Congress in December to become chief executive of the social media venture Trump Media & Technology Group.

Parnas, who was convicted on October 28th of charges related to campaign finance, is currently awaiting sentence.
