(Reuters) – A Philadelphia firm sued Dunkin’ Brands Inc (NASDAQ:) Inc. and Beyond Meat Inc (NASDAQ:) Inc. The lawsuit claimed that the companies infringed their trademark by using “Great Taste, Plant Based” as a slogan to make a vegetarian sausage breakfast sandwich.

Vegadelphia Foods stated in a suit filed Thursday at U.S. District Court Orlando, Florida that they trademarked the slogan “Where Great taste is Plant-Based” before Beyond Meat and Dunkin’ introduced their Beyond Sausage Sandwiches and joint marketing campaigns.

Vegadelphia’s claimed that sandwich ads “flooded” market. This would lead to confusion for potential customers. The Beyond Sausage Sandwich was launched by Dunkin’ in Canton, Massachusetts. However media reports claim that the chain has dropped it off most of their store menus.

The lawsuit was not addressed to Dunkin’ or Beyond Meat immediately. Vegadelphia claimed Friday in a statement that Beyond’s and Dunkin’s “blatant usage of our slogan” and their lack of response have given us the impression that they feel they are above law.

Vegadelphia distributes plant-based meat and poultry through East Coast distributors and El Meson Sandwiches locations in Puerto Rico, Florida. In 2004, the company was established and its slogan received federal trademark protection in 2015.

Vegadelphia claimed that Dunkin’s ads resembled its advertisements, and it used a font with a “sunray,” backdrop. This was in addition to the misleading slogan.

According to the lawsuit, Beyond applied for a trademark nearly identical to “Great Taste, Plant-Based”. The U.S. Patent and Trademark Office rejected Beyond’s 2020 application for a mark based on possible confusion with Vegadelphia’s.

Vegadelphia requested that the court block Dunkin’ and Beyond’s use of the slogan and demanded an undisclosed amount in damages.
