(Reuters) – A federal judge sentenced an Ohio man to 60 days imprisonment for groping and attacking flight attendants on a Frontier Airlines flight last year from Philadelphia to Miami.

U.S. District Judge Robert Scola Jr sentenced Maxwell Berry to one year of supervised freedom after his time in jail, according to the record of Tuesday’s sentencing hearing at a federal court. Berry was to report to prison on August 1, one year after being taken into custody by Miami International Airport in the aftermath of the incident.

Berry, a Norwalk resident, pleaded guilty three counts each of assault. He could face up to 18 years in prison. This incident was caught on cellphone video and went viral. It brought attention to the dangers faced by flight attendants because of the increasing number of disruptive passengers in the COVID-19 epidemic.

Berry was drinking alcohol, and he went to the bathroom on board after spilting a drink. A WPLG police report details that Berry exited the restroom without his shirt.

The police report states that Berry, after walking through the cabin for several hours, groped multiple female flight attendants’ breasts, and punched another male attendant in their face. Berry was restrained by passengers who tied him with tape to his seat for the remainder.

Berry’s lawyer Jason Kreiss stated in an email that the incident was an “absolutely an aberration” in Berry’s life.

Kreiss said that Max is a good child from a wonderful family and was punished for the worst day of his life. “We don’t think 60 days were necessary, based Max’s substantial self-reform and other mitigating circumstances. We still respect the judgement of the court.”
