(Reuters) – Friday’s Delaware court decision ordered Illumina Inc. (NASDAQ:) in the United States to pay $333 Million to a unit of Chinese genetic analysis firm BGI Genomics. The verdict came after Illumina’s DNA sequencing systems were found to have violated two patents.
Also, the jury ruled Illumina had willfully infringed patents and three patents that it had indicted BGI’s Complete Genomics unit for infringing were null.
BGI and Illumina are involved in a legal dispute over the use of their sequencing technology.
Illumina won previously $8 million from BGI, in a San Francisco jury verdict and an order banning U.S. sales for some BGI products.
Complete Genomics Inc of San Jose, California, which is a BGI subsidiary had sued Illumina for its “two-channel” sequencing systems. These kits were used to create DNA fragments that can be sequenced.
According to an Illumina spokesperson, the company will appeal and the verdict shouldn’t affect the ability of the company to deliver its products to its customers.
CGI’s attorney said that the verdict was a positive one.
