NEW YORK (Reuters), Two children of Ricardo Martinelli, former Panamanian president, will face trial in the United States for their role in laundering millions of dollars of bribes that Odebrecht in Brazil made to a Panamanian high-ranking official.
Ricardo Martinelli (43), who has the same name and father as Luis Martinelli (44) is being sought by the prosecution for a sentence of 9 to 11 years in prison.
Odebrecht pleaded guilty to money laundering and bribery in 2016 for the payments of $700 million to Latin American officials to secure contracts.
Last year the Martinelli brothers pleaded guilty to money laundering conspiracy. U.S. authorities allege that they set up offshore bank accounts under the names shell companies in order to obtain bribe payments Odebrecht paid while their father was president of 2009 to 2014.
In court papers, the prosecution argued that both men’s sentences would show that cheating and stealing from others to gain their wealth and profits will result in them being held responsible.
They were both extradited to Guatelama by their brothers and have asked for sentences of time served. That would allow them to spend less time in jail. Each brother was represented by lawyers who argued that they should have been credited for nearly two years spent in Guatemalan jail.
U.S. District Judge Raymond Dearie will decide the sentences at 4 pm. ET hearing in Brooklyn (2000 GMT).
Ricardo Martinelli, the elder Ricardo Martinelli, has been cleared of all charges. However, he is still under investigation in Panama for a different case involving Odebrecht. He maintained his innocence.
The Panamanian attorney general, who is currently investigating the Martinelli brothers as well, announced on Friday that it would send two of its prosecutors to the hearing.
