(Reuters) – The U.S. cannot proceed immediately with plans to lift the pandemic restrictions which allowed agents at Mexico’s border to return migrants to their homes without allowing them to apply for asylum. A Louisiana judge stated Friday.

Robert Summerhays, U.S. District Judge, issued a nationwide injunction that means the existing restrictions across the border will continue to apply as litigation continues. This is in addition to any appeals by the U.S. Department of Justice.

Title 42 is the pandemic restriction that was put into place during Trump’s administration. Trump is an immigrant hardliner. According to the U.S. Centers for Disease Control and Prevention, the pandemic restrictions were necessary in order to prevent the spread and spread of the coronavirus.

Over a million migrants who were arrested at the border in the last few days have been quickly expelled to Mexico and other countries by the order.

President Joe Biden is a Democrat. He took office January 20, 2021.

Due to increased access to vaccines, Title 42 no longer was necessary for COVID-19 prevention. To prepare for the end, border officials were allowed to wait until May 23, according to the health agency.

A coalition of twenty-six states, including Missouri, Louisiana, and Arizona joined forces with Republican lawyers general to stop the Biden administration ending this policy. A Trump appointee Judge Summerhays stated that a nationwide injunction was necessary because of the freedom for immigrants to cross the border and move between states.
