Tesla loses bid to move sexual harassment lawsuit to arbitration -Breaking

(Reuters) – A California judge rejects Tesla Inc (NASDAQ:) Inc’s attempt to submit a lawsuit alleging widespread harassment at its flagship assembly facility to private arbitration. This allows it to continue in court.

California Superior Court Judge Stephen Kaus of Oakland rejected Tesla’s motion for arbitration. On Monday, he issued a quick order with no explanation.

Jessica Barraza was representing the plaintiff. She argued that her arbitration agreement, which required her not to make legal claims in private proceedings but still allowed Tesla to sue in public, was invalid.

Barraza, in the November lawsuit, claims Fremont plant workers and supervisors made routinely lewd comments to female employees. The company also failed to respond to complaints.

This lawsuit is just one of seven that are pending before a California state court in order to bring similar claims against Tesla. Kaus preside over five other cases.

Tesla didn’t immediately reply to my Tuesday request for comment. Barraza did not have a lawyer.

Tesla, in addition to the sexual harassment lawsuits, is also facing separate suits alleging it has tolerated widespread racial discrimination at its plants. California’s Supreme Court awarded $15 Million to a former Black factory worker, who claims he was the victim of racist slurs from his fellow workers.

Tesla claims it will not tolerate harassment. Employees who engage in misconduct have been fired or disciplined.
