NEW YORK, Reuters – Kevin Spacey was denied a motion to dismiss a civil suit in which Anthony Rapp, a fellow actor accused Spacey of an unwelcome sexual advances during a party in Spacey’s Manhattan residence in 1986. Rapp was then 14.

U.S. District Judge Lewis Kaplan of Manhattan stated that there was genuine dispute over whether Spacey (now 62) forcibly touched Rapp’s “intimate part” in order to satisfy his sexual desires.

Rapp could file claims for battery and intentional injury to emotional distress. Rapp’s assault case was denied by him because it was brought late.

Rapp and Spacey’s lawyers didn’t immediately reply to inquiries for comment.

Spacey, once one of Hollywood’s most prominent stars with Oscars nominations for “American Beauty”, and “The Usual Suspects,” has mostly disappeared from public sight since 2017 when he was publicly charged with sexual misconduct.

Spacey claimed that he was not aware of the incident with Rapp at the time. But, Spacey did say that Rapp would be remorseful for his “very inappropriate and drunken” behavior.

Rapp stated under oath, that the encounter was not sexualized, undressed, reached underclothes, or involved any innuendo. It lasted less than 2 minutes.
