Moscow court rules antitrust case against Apple is lawful

(Reuters) – A Moscow court ruled Thursday that Russia’s antimonopoly regulator could open an antitrust lawsuit against Apple (NASDAQ) for a dispute over App Store payments. This decision dismissed a U.S. case, according to the RIA news agency.

Russia filed the antitrust suit against Apple in Oct., accusing it for not giving developers access to alternative payment options. The Russian government said that Apple may face a penalty based upon its Russia revenue if it is found guilty.

Apple and Russia’s Federal Anti-monopoly Service did not immediately reply to inquiries for comment.

RIA claimed that Apple had been dismissed in all aspects by the Moscow Arbitration Court. According to RIA, the Moscow Arbitration Court had ruled that Apple’s case could be appealed.

Separately, law firm Chernyshov, Lukoyanov & Partners on Wednesday said it was preparing a lawsuit against Apple for what it said was a violation of Russian consumers’ rights after the company restricted the use of Apple Pay on March 1 in response to Russia sending tens of thousands of troops into Ukraine on Feb. 24.

This same law firm also filed a lawsuit against Netflix (NASDAQ:) in a similar case. In March, Netflix temporarily suspended service in Russia. It stated it had stopped all new acquisitions and future projects.
