California law prohibits secretly removing condom during sex By Reuters

(Reuters) – On Thursday, the California Governor Gavin Newsom signed a law that bans “stealthing,” which is taking a condom without consent. This makes it a civil criminal sexual battery offense.

According to the Sacramento Bee, it is the nation’s first anti-stealthing legislation. Assemblywoman Cristina Garcia (the bill’s sponsor) stated in a statement that the bill had passed both the Senate and Assembly without opposition a month earlier.

“I have worked on the issue of stealthing since 2017, and I’m thrilled that the law now holds those responsible accountable for their actions. Garcia released a statement after the bill passed. Garcia explained that the issue of sexual assaults against women of color is often ignored.

Garcia mentioned a Yale University study that described theft as “a grave violation in dignity and autonomy”, and stated cases affecting gay men and women were increasing.

According to the law, anyone who removes a condom from someone without their consent may be subject to punitive and general damages.
