BERLIN, (Reuters) – A second online consultation will take place for residents of Berlin to object to Tesla’s factory (NASDAQ;) near Berlin. The decision was made by the regional environmental ministry on Thursday. It is concerned that the process didn’t comply with regulatory requirements.

Elon Musk, Tesla CEO, stated at an Oct. 9 visit to Gruenheide’s factory that he expected to begin production in November. This seems unlikely considering authorities need to first examine the most recent submissions and decide whether or not to approve.

According to the statement, this repeated process is only for those who have expressed objections in the previous rounds of public consultations but weren’t satisfied by the responses from Tesla or from the environment ministry. It will take place from November 2-22.

Tesla didn’t immediately reply to our request for comment.

After environmental groups challenged in another case, authorities decided to go back to that process. Citizens were not informed in sufficient advance of the digital consultation. This raised concerns about the Tesla consultation.

It stated that it was difficult to determine which Brandenburg administrative court would follow in the case of a lawsuit without sample cases. Therefore, the licensing authority decided to conduct a second online consultation on the emission control procedure for vehicle factories to ensure legal certainty.

The statement stated that objections submitted during the previous round would still be valid.

Musk expressed frustration at German laws during his struggle to make production at the site operational over the past two years. He claimed that the complex planning requirements and the need to combat climate change were incompatible with Musk’s efforts to bring it to fruition.

Both the factory and its adjacent battery plant will produce 50 Gwh each year, and at minimum 500,000 electric vehicles per year. This is more than any German competitor.
