NEW YORK (Reuters). A New York prosecutor decided to drop a misdemeanor sex offense charge against Andrew Cuomo. The New York prosecutor said he was unable to prove the elements that constitute a crime beyond a reasonable suspicion.

David Soares the Albany County District attorney stated in Tuesday’s statement that he had reviewed the complaint filed by Brittany Commisso, a former Cuomo aide. His office found Commisso “cooperative” and credible.

He stated, “I, along with most New Yorkers remain deeply troubled about allegations such as the ones at issue here.” “Such behavior has no place at all in government, or any work environment.”

Cuomo was a Democrat and ran New York State for a decade. In August, a state probe found that he had sexually harassed eleven women (mostly state workers).

Commisso (then a Cuomo aide) was in her 30s when she groped Commisso at Albany’s Executive Mansion in 2020. Cuomo was charged with forcible touch by Albany County Sheriff Craig Apple (NASDAQ) in October.

Even the prosecutor was taken aback by the complaint. He asked for Cuomo to be rescheduled to January 7, claiming that Cuomo had unilaterally acted and his complaint was potentially defective.

Rita Glavin (Cuomo’s attorney) did not respond when asked for comment. The county sheriff’s spokeswoman declined to comment. Cuomo claimed he never inappropriately touched any person and suggested that his attempts to be friendly with his boss might have been misinterpreted as flirting.

The most severe individual case in Cuomo’s state report was Commisso’s. However, reports claim that Cuomo began to investigate whether Cuomo had harassed female employees.

Other county prosecutors investigated the individual complaints but declined to press charges.

Brian Premo was Commisso’s attorney and told the Albany Times Union that she planned to file a civil lawsuit against Cuomo.
