Djokovic back in court to fight deportation from Australia

[ad_1]

Novak Djokovic was back in court to defend his deportation attempt. It had been attempted because of what a minister from the government described as Novak Djokovic’s perception of Novak Djokovic being a “talisman” of an anti-vaccination community.

The case will be heard by three Federal Court judges in one day. This would allow the No. 1 male player to defend his title. The defense of his title in the inaugural Grand Slam tennis tournament could begin Monday by the No. 1 tennis player, and nine-time Australian Open champion.

Djokovic spent Saturday night at hotel immigration, and his attorneys had an early morning meeting with officials from immigration.

TV footage captured the Serb, 34 years old, wearing a mask while he sat next to an Immigration Detention Hotel.

While he’s being held in hotel detention, he can leave to go to his attorneys’ offices to see Sunday. He will remain there under two immigration officials while the challenge hearing is conducted via video.

Djokovic spent four night in Melbourne’s hotel room before being allowed to leave. He was released on Monday following a legal challenge against the cancellation of his visa.

On Friday, Alex Hawke (Immigration Minister) blocked the visa. It was initially revoked after he arrived at Melbourne’s airport in January.

A three year ban from returning to Australia after being deported can be imposed upon you. However, this may be lifted depending on your circumstances.

James Allsop, Federal Chief Justice of the United States, gave reasons on Sunday for rejecting Hawke’s claim that Hawke’s case was only worthy to be heard by one judge.

Allsop used Hawke’s words to explain why he decided to cancel his visa.

Three judges are far more likely to appeal a verdict than one judge.

Allsop stated that Jokovic couldn’t appeal the decision on Sunday or Monday to allow him to play in the Australian Open.

Allsop stated that Mr. Jokovic’s appeal, even if it was lost, would be or perhaps in least partially rendered ineffective because the start of the event is so close to his destination and his visa.

Djokovic’s lawyers filed court documents that showed Hawke stated that Hawke was “perceived by some as an omen of anti-vaccination sentiment.”

Australia boasts one of highest COVID-19 vaccination rates.

The minister stated that Djokovic’s presence may pose a threat to Australia’s health and “good order”, and could “counterproductive efforts to have others in Australia vaccinated.”

Djokovic had a very low chance of contracting COVID-19, according to the Health Department.

Djokovic said in April 2020 that the minister was against vaccination and didn’t wish to be forced to have a vaccine.

Djokovic’s attorneys argued that Djokovic hadn’t cited any evidence to suggest that Djokovic’s presence could “foster an anti-vaccination feeling.”

A peaceful demonstration was held outside Melbourne Park where the Australian Open is being hosted. There were hundreds of participants and plans for another one on Monday.

Novak is our supporter. Here, he’s been awarded nine titles (Australian Open). It’s hoped that this title will become No. Harrison McLean said that 10 would be possible if the man can leave quarantine and obtain his visa back. “We are a peaceful movement. We want to increase awareness and support freedom of choice.”

Federal Chief Justice James Allsop said Saturday that he would be hearing the case together with Justices David O’Callaghan & Anthony Besanko.

Three judges will hear appeals instead of one judge. This elevates the case’s importance from the perspective of the judiciary and makes it less likely that any verdict is appealed.

Simon Jeans, a Sydney immigration lawyer said that he was shocked that Djokovic wasn’t being removed from Australia. This was because Djokovic’s Covid-19 infection did not allow him to be exempted from Australia’s stringent rules that all foreigners must get vaccinated.

It remains unanswered whether Djokovic was a danger to order and if so, then why did Jeans grant Djokovic a visa in November. Jeans asked. Jeans said, “This strategy is high-risk. The minister will have to convince the three judges that what they did was in public interest.

Djokovic is aiming for a 21st Grand Slam singles title. He has already won three Australian Open titles. Djokovic currently holds the record for greatest singles title won by a male in history with Roger Federer, Rafael Nadal, and Rafael Nadal.

Djokovic, in a Wednesday social media post that was his longest public commentary on this episode yet, blamed his agent. Djokovic called it a “human error” and said it wasn’t deliberate.

Djokovic stated in the same posting that he continued with an interview with and photoshoot for a French newspaper in Serbia, despite having tested positive for COVID-19. Djokovic tried to claim that his positive Dec. 16 test was sufficient to allow him to get a medical exemption to the vaccination requirement. This would be because he has COVID-19.

Hawke stated that Prime Minister Scott Morrison was “firmly committed” to Australia’s borders and the COVID-19 pandemic.

Australia’s episode is a touching one, especially Victoria State, which saw locals go through more than 220 days of lockdowns in the worst phase of the pandemic.

Australia is facing a huge surge in viral cases due to the transmissible Omicron variant. Australia reported almost 35,000 cases of the highly transmissible omicron variant on Friday. Although infected individuals aren’t as sick now as in past outbreaks, this surge continues to put severe pressure on our health systems and disrupt supply chains.

The visa cancellations have dismayed Djokovic supporters in Serbia. Aleksandar Vucic, Serbia’s President, accused the Australian government “harassing and maltreating Djokovic” and asked if Morrison’s government was simply trying to win political points in advance of the upcoming elections.

“Why didn’t you immediately return him or inform him that it wasn’t possible to obtain a visa? Vucic reached out to the Australian authorities through social media. Vucic asked the Australian authorities in a social media address, “Why do you harass him? And why are you treating not only his family but also a nation free and proud?”

Everybody attending the Australian Open must have a current vaccination.

Grand Slam rules stipulate that Djokovic must withdraw from tournament before the Order of Play for Day One is published. Djokovic will be moved to the spot of 5 seed Andrey Rublev.

If Djokovic withdraws from the tournament after Monday’s schedule is released, he would be replaced in the field by what’s known as a “lucky loser” — a player who loses in the qualifying tournament but gets into the main draw because of another player’s exit before competition has started.
